Valid Consent

For consent to be legally valid in Australia, it must meet the following criteria:

  1. Voluntary
    • The patient must provide consent without coercion, manipulation, or undue pressure.
  2. Informed
    • The patient must be provided with all relevant information, including:
      • The nature of the proposed treatment.
      • The benefits, risks, and potential complications.
      • Any alternative treatments or options.
      • The consequences of not undergoing the treatment.
  3. Capacity
    • The patient must have the capacity to make the decision, which includes understanding the information provided, weighing the options, and communicating their decision.
    • For minors or patients with impaired capacity, consent must be obtained from a legal guardian or substitute decision-maker.
  4. Specificity
    • Consent must be specific to the procedure or treatment being proposed.
  5. Current
    • Consent must be obtained reasonably close to the time of the procedure to ensure the patient’s decision reflects their current circumstances.

Informed Consent

Informed consent is a process, not just a signed form. It ensures the patient understands what they are agreeing to. This process includes:

  1. Effective Communication
    • The practitioner should communicate in a language and manner the patient understands, avoiding medical jargon.
    • Consideration should be given to patients from diverse linguistic or cultural backgrounds or those with disabilities.
  2. Adequate Disclosure
    • Provide all relevant details about the procedure, including common risks and rare but serious complications.
    • Discuss alternatives and why the recommended treatment is suggested.
  3. Opportunity for Questions
    • Patients should have the chance to ask questions and have them answered thoroughly.
  4. Documenting Consent
    • Written consent is recommended for complex or invasive procedures. For routine treatments, verbal consent may suffice but should be documented in the patient’s records.
